1.1 Acceptance of Terms
By accessing, purchasing, or using any service provided by Shine Servers LLP ("Company", "We", "Us"), the customer ("Client", "You") agrees to be legally bound by these Terms of Service, Acceptable Use Policy, Privacy Policy, Service Level Agreement, Cookie Policy, and Copyright Infringement Policy. Acceptance is deemed complete upon online signup, invoice payment, service activation, or continued use of services.
1.2 Scope of Services
1.2.1 Web Hosting
Includes shared hosting, reseller hosting, and managed hosting environments.
- Company Obligations: Maintain server availability, basic infrastructure security, and network connectivity.
- Client Obligations: Manage website content, scripts, databases, updates, and backups. Ensure hosted content is lawful and secure.
- Limitations: Resource abuse, insecure scripts, or malicious content may result in suspension.
1.2.2 VPS Cloud Servers
Virtual Private Servers provisioned on shared cloud infrastructure.
- Company Obligations: Provide virtualized compute resources, network access, and hypervisor stability.
- Client Obligations: Full responsibility for OS, applications, security patches, firewall configuration, and data backups.
- Limitations: VPS services are unmanaged unless explicitly stated. Performance may vary due to shared infrastructure.
1.2.3 Bare-Metal Dedicated Servers
Physical servers exclusively allocated to the Client.
- Company Obligations: Hardware availability, replacement of faulty components, and data center connectivity.
- Client Obligations: Full responsibility for operating system, applications, data, security, and compliance.
- Limitations: No responsibility for software issues, misconfiguration, or data loss.
1.2.4 Digital Marketing Services
Includes paid advertising strategy, campaign setup, and performance optimization.
- Company Obligations: Provide professional services based on information supplied by the Client.
- Client Obligations: Approve creatives, provide accurate business information, comply with platform policies.
- Limitations: No guarantee of specific results, leads, conversions, or revenue.
1.2.7 Application & Web Development
Includes custom software, web applications, and websites.
- Company Obligations: Deliver services as per agreed scope, timeline, and specifications.
- Client Obligations: Provide clear requirements, approvals, and content.
- Limitations: Scope changes may incur additional costs. Delays caused by Client are excluded from timelines.
1.3 Client Obligations
- Provide accurate identity, billing, and contact information
- Maintain secure credentials and system configurations
- Ensure compliance with all applicable laws
- Maintain independent backups of all data
1.4 Billing, Payments & Taxes
1.4.1 Accepted Payment Methods
- PayPal
- Stripe (Credit / Debit Cards)
- Razorpay (Credit / Debit Cards, Net Banking, UPI)
- Cryptocurrency Payments via Cryptomus (including BTC, ETH)
1.4.2 Billing Terms
- All services are billed in advance unless otherwise agreed in writing.
- Prices are exclusive of applicable Indian taxes unless explicitly stated.
- Non-payment beyond 4 calendar days may result in suspension or termination without notice.
- Cryptocurrency payments are non-reversible and final once confirmed on the blockchain.
1.5 Suspension & Termination
Shine Servers LLP may suspend or terminate services immediately in the event of:
- Payment default or chargebacks
- Violation of Acceptable Use Policy
- Security threats, abuse complaints, or legal risk
- Non-cooperation with compliance or verification requests
Termination does not relieve the Client of outstanding payment obligations.
1.6 Data Responsibility & Backups
The Client bears sole responsibility for all hosted data. Shine Servers LLP shall not be liable for data loss, corruption, or deletion under any circumstances.
1.7 Limitation of Liability
To the maximum extent permitted by Indian law:
- Liability is limited to fees paid in the preceding two (2) months
- No liability for indirect, incidental, consequential, punitive, or loss-of-profit damages
1.8 Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of India. Courts located in New Delhi, India shall have exclusive jurisdiction.
